Terms and Conditions

General Release

In consideration of Participant being permitted to participate in the Event(s) named on their calendar list (“Event”), Participant, individually and on behalf of his/her heirs, personal representative(s), and assigns, waives, releases, and forever discharges Noble Frog Tours, its trustees, agents, and employees from and against any and all liability for any harm, injury (including death), damage, claims, demands, actions, causes of action, costs, and expenses of any nature whatsoever, which arise out of, occur during, or are in any way related to Participant’s participation in the Event, including any travel or lodging incident thereto or resulting therefrom.

General Release — Travel

Participant understands that certain risks are associated with traveling to and/or staying in a different area or country. Risks include, but are not limited to:

• Travel delays
• Schedule changes
• Weather-related incidents and delays
• Emergency and medical care
• Property damage, economic loss, illness, injury, death, or other physical, mental, or emotional injury arising from accident, war, quarantine, civil unrest, terrorism or other violent conduct, public health risks including lack of sanitation, criminal activity, exposure to communicable diseases, ill effects of unfamiliar food and water, various types of incidents and accidents including those related to ground, air, or water transportation, adverse weather, cultural differences, natural disasters, and acts of God.

Participant hereby knowingly and voluntarily assumes each of the foregoing risks, and all other risks arising or occurring during his/her travel to, from, in, and around the host or any other country or area, and releases Noble Frog Tours from any liability associated with such risks.

Media/Photo Release

Consent to Record Image and Voice

Participant unconditionally, irrevocably, and voluntarily consents to being photographed, videotaped, and/or audio taped by Noble Frog Tours.

Consent to Use of Image, Voice, and Testimonial

Participant unconditionally, irrevocably, and voluntarily authorizes Noble Frog Tours to use Participant’s name, image, likeness, voice, and/or testimonial for purposes of advertising, marketing, promoting, or publicizing Noble Frog Tours and/or Noble Frog Tours programs, or for any other lawful purpose.

Forms of Media

Participant unconditionally and irrevocably authorizes Noble Frog Tours to publish Participant’s name, image, likeness, voice, and/or testimonial in any form of media, including any media that may be developed or created in the future.

Such forms of media may include, but are not limited to, radio, television, multimedia presentations, social media, websites, and printed publications.

No Right to Approve

Participant waives any right to inspect or approve the finished product, including written copy, wherein Participant’s name, image, likeness, or testimonial appears.

No Compensation

Participant hereby waives all rights to compensation or other consideration for the rights granted to Noble Frog Tours under the terms of this Agreement.

Medical Treatment

Participant assumes responsibility for medical treatment and the costs of such treatment.

Participant releases and discharges Noble Frog Tours of all responsibility and liability for any injuries, illnesses, claims, damages, charges, bills, and/or expenses he or she may incur for emergency or medical care, or medical transportation, while participating in the Event and while traveling to or from the Event.

Standards of Conduct

Participant understands that Participant is a representative of Noble Frog Tours while participating in the Event and while traveling to or from the Event.

Noble Frog Tours reserves the right to expel any participant who violates the law, rules, regulations, or policies of Noble Frog Tours, the host country, or any rules or standards surrounding the Event.

Additional Expenses

Noble Frog Tours shall have no obligation to pay for or refund any fees or expenses Participant may incur, including but not limited to travel, lodging, and legal expenses related to expulsion, travel delays, or criminal infractions.

Governing Law

This Waiver and Release shall be governed by and construed in accordance with the laws of the State of Michigan.
